Item 1: PUBLIC HEARING 8-3-21 – Zone Change Application for Ivan Troshchiy to change from RA to RO at 405 Ingleside Street to rezone in a manner consistent with development patterns in the area.

Item 2: PUBLIC HEARING (continued from 7-27-21) 6-15-21 – Zone change proposal to create a Retail Center (RC) zone taking into account both present tenancies and desired future development of such properties with appropriate criteria to ensure proper cohesive uses and promote continued mixed commercial/retail in Holyoke.

Item 3: PUBLIC HEARING (continued from 7-27-21) 6-15-21 – Zone change proposal to have the City of Holyoke remove from its Code of Ordinances, Appendix A, Zoning Ordinance, Section 8.3 “Shopping Center Districts” and any other references to said zone and replace with Retail Center (RC).

Item 4: PUBLIC HEARING (continued from 7-27-21) 6-15-21 – Zone change proposals to rezone the following parcels to Retail Center (RC) in an effort to create a cohesive regional destination district of mixed commercial / retail which all property owners will share the same regulations: 12 Holyoke St (117-00-005), 229-241 Whiting Farms Rd (174-00-013), 227 Whiting Farms Rd (174-00-013A), Lower Westfield Rd (174-00-013B), 95 Lower Westfield Rd (174-00-016), 250 Whiting Farms Rd (174-00-017), 225 Whiting Farms Rd (174-00-018), 7 Holyoke St (174-00-020), 98 Lower Westfield Rd (174-00-021), 94 Lower Westfield Rd (174-00-022), 86 Lower Westfield Rd (174-00-024), Whitney Ave (176-00-010B), 50 Holyoke St (176-00-010C), 400 Whitney Ave (176-00-013), Whitney Ave (176-00-014), 489 Whitney Ave (176-00-014.1), 494 Whitney Ave (176-00-027), 496 Whitney Ave (176-00-028), Whitney Ave (176-00-029).

Item 5: 9-7-21 HERNANDEZ — Ordered that the ordinances be updated to reflect that Columbus Day will now be referred to as Indigenous Peoples Day.

Item 5a: 9-7-21 From Kathleen Degnan, Assistant City Solicitor, Legal drafts establishing Indigenous Peoples Day

Item 6: 9-7-21 MURPHY — Ordered that the city council work with the mayor to establish an ordinance which will set the guidelines for flag raising events in the city.

Item 7: 8-4-20 ANDERSON-BURGOS — Ordered, that the language in the Holyoke municipal code, Sec 14-5, (a),(1), a, be removed from the code. The language of this code reads as: “A dog may be off restraint if under adequate voice control of a person, and that person has a leash in their possession. A dog which does not respond to commands of the person in control of such animal is not under restraint.” This language, especially “if under adequate voice control,” is overly subjective and does nothing to protect another person or animal from injury should a dog owner not maintain control of their dog.

Item 8: 6-26-18 LISI — Ordered, that the City Council, in accordance with MGL Chapter 43, Section 43, submit the following question to the voters at the next biennial state election: “shall this City allow the sale of marijuana products, as those terms are defined in G.L. c.94G, 1, for consumption on the premises where sold, a summary of which appears below?” Passage of this order shall be contingent on the state legislature’s approval of House Bill 4284 or other legislative/interpretive change to M.G.L. c.94G, sec 3(b) deemed acceptable by the Secretary of the Commonwealth.
